UCAR seeks preliminary injunction against federal administrative agencies

The legal filing seeks to halt steps to transfer the NCAR-Wyoming Supercomputing Center

Today, the University Corporation for Atmospheric Research (UCAR) filed a motion seeking a preliminary injunction to halt the action being taken by federal agencies to divest UCAR and NCAR of their stewardship, maintenance, or operations responsibilities over the NCAR-Wyoming Supercomputing Center (NWSC). This motion follows and relates to the complaint UCAR filed on March 16, 2026. 

The request for a preliminary injunction was filed in the United States District Court for the District of Colorado against the federal agencies named in UCAR’s March 16 lawsuit: the U.S. National Science Foundation (NSF); the National Oceanic and Atmospheric Administration (NOAA); the United States Department of Commerce (DOC); the United States Office of Management and Budget (OMB); and their respective directors in their official capacities.

In its complaint, UCAR asserts that the federal agencies have not followed the law and required procedures and that the decisions made with regard to the NWSC are motivated by retaliation against Colorado. In the motion, UCAR argues that if this action were to continue, it would result in irreparable harm including job losses, disruption to ongoing research projects, and contractual liabilities to other agencies and third parties. 

UCAR and NCAR will not be making any further public comment while this litigation is pending. For more information, please refer to the complaint filed on March 16, 2026.
