Today, UCAR amended its complaint in the lawsuit filed on March 16, 2026, to reflect developments that have occurred since that time. The amended complaint, filed a short time ago in the federal District Court of Colorado, both updates existing counts with new facts and adds new counts and claims against the U.S. National Science Foundation (NSF), the National Oceanic and Atmospheric Administration (NOAA), and the Office of Management and Budget (OMB) regarding their failure to respond to UCAR’s request for agency records under the Freedom of Information Act (FOIA). This new filing does not affect the preliminary injunction that was issued by U.S. District Judge R. Brooke Jackson on June 1. This injunction prevents the transfer of stewardship of the NCAR-Wyoming Supercomputing Center (NWSC) to another operator and preserves the status quo while the lawsuit is fully litigated.
